OEPM registration takes 3–6 months; official fees are around €148 per class. An EU trade mark (EUIPO) takes 3–4 months with fees from around €850. A prior-art search is strongly recommended.

What should I do if someone is using my trademark without authorisation?

The first step is a cease and desist letter. If the infringer does not comply, you can file a court action or complaint with the OEPM and apply for urgent interim measures.

Does a work need to be registered for copyright protection?

No. Copyright arises automatically upon creation. Registration is not mandatory but is strong evidence in any dispute.

Is a Chinese trademark automatically protected in Spain or the EU?

No. You must register it with the OEPM or EUIPO, or via the Madrid System. We recommend doing this before entering the European market.
