International students who complete their studies in Spain and wish to start a business may consider applying for a temporary residence and self-employment work permit. The application must demonstrate a genuine, viable and properly funded business project.
Many international students wish to remain in Spain after graduation without relying on an employment contract from a Spanish company. They may plan to open a shop, operate an online business, establish a commercial project or provide independent professional services.
Depending on their academic and immigration circumstances, they may be eligible to apply for a temporary residence and self-employment work permit. This type of authorisation allows the applicant to operate a business or work independently in Spain rather than being employed by another company.
Incorporating a company does not automatically lead to approval of the residence application. The immigration authorities assess the proposed activity, the commercial viability of the project, the amount of available investment and the applicant’s professional ability to establish and operate the business.
A restaurant, beauty salon or retail shop will require different documents and financial resources from a consulting, design, translation or e-commerce project. The business does not need to be large, but it must be realistic and consistent with the applicant’s qualifications, professional background and financial situation.
Since there is no employer providing an employment contract, the applicant must personally demonstrate that the project can be implemented. The supporting documents normally explain the proposed activity, initial investment, potential clients, operating model and the applicant’s relevant professional experience.
Businesses requiring commercial premises, municipal licences, professional qualifications or sector-specific permits must also address those requirements. The information contained in the business plan should be consistent with the financial evidence, contracts, quotations and supporting documents submitted with the application.
Two recent self-employment applications handled by our firm received favourable decisions. The first application was filed in Madrid on August 26, 2025, and approved on February 4, 2026, after slightly more than five months. A one-year temporary residence and self-employment work permit was granted.
The second application was filed in Murcia on September 26, 2025, and approved on March 23, 2026. The decision required the applicant to complete the relevant registration with the Spanish Social Security system within the specified period. The one-year validity period began once that registration was completed.
